So, I thought it important to go over some of the rules that govern the final recording of a mechanic's lien and the enforcement of mechanic's lien rights here in California. Let's first talk about the distinction. If you are not in direct contract with the owner of a project or a home, then you need to file something called a 20-day preliminary notice. When I say file, you need to serve it by certified mail return receipt requested against the lender, the owner of the property, and against any general contractor for the property. If that 20-day prelim has not been sent by certified mail with return receipt requested, your subsequent mechanic's lien rights are unenforceable. Therefore, you are unable to file the mechanic's lien without the filing of the 20-day notice. If you are in indirect contract with the owner, then you can just file the mechanic's lien. If you have unpaid issues or if you are in a dispute with your contractor and he has already filed or recorded the mechanic's lien with the County Recorder's office, then you need to make sure the following takes place. Once the mechanic's lien is recorded, or if it gets recorded, you have 90 days to enforce the mechanic's lien rights. This means that as soon as the contractor records the mechanic's lien, they must file a lawsuit to enforce those rights. If they don't file a lawsuit within a 90-day period, 30 days after those completions have been filed, then they waive those mechanic's lien rights....
